Start review of caning in schools It was reported that in schools, corporal punishment is allowed for male students in severe cases of a grave or repeated misconduct and that such punishments are carried out in private (Most parents here don't spare the rod on kids at home: Study, July 30). I commend the Ministry of Education's (MOE) guidelines on how corporal punishment is carried out as it maintains the offender's dignity and ensures he commits to a path of redemption and counselling. Certain schools have even abolished corporal punishment and opted for counselling and follow-up guidance instead. The term "grave or repeated misconduct" is broad and subjective. It is about time MOE started a review on caning. Offences liable for corporal punishment should be streamlined, specific and standardised throughout Singapore's education system. Drug courier spared death now challenges caning sentence Malaysian drug courier Yong Vui Kong, who was spared the gallows after a string of unsuccessful fights against his death sentence, is now challenging the caning regime in Singapore. Yong, 25, was re-sentenced in November last year to life imprisonment and 15 strokes of the cane. This followed changes to the law which give judges the discretion to impose life terms and caning, instead of the previously mandatory death penalty, for drug couriers who help the authorities in a substantive way. However, Yong filed an appeal last week, asking for his caning sentence to be quashed. 'This is something we've made clear in our human rights report and also something we've conveyed to the government of Singapore in our bilateral discussions,' said State Department spokesman Mark Toner on Thursday. Kamari Charlton, an American businessman and a former football player for Florida State University, may become the first US citizen to be caned in Singapore in 16 years after he overstayed his visa. 'He has not been convicted, and in fact the case is still in pre-trial status,' Mr Toner said, adding the US embassy in Singapore is closely monitoring it. 'It's our hope that a resolution can be reached in the case,' he said. The Syariah High Court in Pahang also handed the same sentence to a man on Monday, and is due to make a decision on another woman in May. Mohamad Nasir Mohamad, 38, a father of four, and waitress Noorazah Baharuddin, 22, were found drinking beer separately in pubs in July last year in central Pahang state, said reports released yesterday. Nasir admitted that he had drunk beer at a pub in Cherating on July 11, while Noorazah was caught drinking at the pub where she worked, in Jalan Gambut. Both were also fined RM5,000 (S$2,100) each by the Pahang court on Monday. The third accused was part-time model Kartika Sari Dewi Shukarno, 32. According to the New Straits Times, Kartika, a Singapore permanent resident, could not attend court as she is studying in Singapore. Judge Abdul Rahman Yunus said that he had given the maximum fine and caning as a deterrent to other Muslims, but had spared them a jail sentence. 'The caning is to shame them and should be done at any of the prisons in the country,' he was quoted as saying by NST. The case comes after two controversial fatwas, or edicts - one over tomboyish behaviour by women and the other concerning the practice of yoga - sparked intense public debate over decisions made by the country's top religious body. Malaysia has a two-track legal system, with the civil courts operating alongside state-based syariah courts. Muslims are governed by syariah laws in family and personal matters, while ethnic Chinese, Indians and other races come under civil courts. According to NST, this is the second time such a sentence has been handed down. In 2005, the same judge sentenced two Muslim brothers to six strokes of the cane after they were caught drinking. However, the caning has yet to be carried out as the men are appealing against the decision. Alcohol is widely available in Malaysia, and Muslims are rarely punished for consuming it. 'It's rare but it's within the law and Muslims are subject to such law in this country,' said lawyer Pawancheek Merican, a syariah law committee member of the Malaysian Bar Council. MP Salahuddin Ayub, the youth chief of the opposition Islamic party PAS, said he 'agreed' with the court ruling. 'The ruling only concerns Muslims and it does not affect the non-Muslims. SINGAPORE (AFP) - - A Singaporean man with a fetish for smelling womens' armpits has been sentenced to 14 years in jail and 18 strokes of the cane, legal officials said Friday. A court employee confirmed the sentence, issued Thursday, against Mohammed Ismail Ariffin, 36. Ariffin had a fixation for touching or smelling women, particularly their armpits, and was convicted of molesting 23 women, his lawyer Noor Mohamed Marican told AFP. "He's got this problem. Poor chap," Noor said in a brief interview. After reading an expert report that said Ariffin was likely to re-offend, Judge James Leong issued a preventive detention order, which means Ariffin will not be eligible for parole, The Straits Times said. Ariffin, who is mildly retarded, would often attack his victims inside lifts, the report said. It said Noor argued against a long sentence and in favour of rehabilitation and medical treatment.
