My frd frequently visit the above shop to wash and polish his car. Everyweek,twice a week,he's been sending his car to Radianz... On Monday 15/9,he send his car in for its regular washing....However,in the afternoon,he rec a call from the shop,saying that a worker has crashed his car while trying to shift it ard the shop.Even worse,the person driving it does not possess a license.The shop wanted to sent it to their workshop but my frd insisted that they tow it to C&C service centre instead. When my frd went down to inspect the damage,to his horror,he saw that his front rims were bent,fog lights was dangling...the service advisor there says that there's some chasis damage also. He went down to the shop,and asked the worker for the truth.Apparently,the worker had taken his car out for a joy-ride,lost control and went up a kerb! My frd asked the worker to write down on paper what has happened, made him sign it....the worker did as told,but pleaded with my frd to give him a chance.He says he will pay 4 d damages....The guy abt 18yrs old n was driving without a license,so my frd tot he'll not report the case to the police,if the shop owner agrees to pay 4 the damages caused. However,the shop owner refused to pay,saying that the worker involved was instructed not to drive the customer's cars and that its none of his biz!He'll see my frd in court if my frd wanted compensation!Having said that,he hung up on my frd!When my frd tried to call him again,he rejected the call!!Basically,the shop owner is trying to push all the blame to the poor 18yr old boy in order not to suffer monetary loss. I was told tat d shop only has 2 licensed drivers,n one of them is THE owner!!The owner is seldom ard,which leaves only 1 driver...Now that something has happened due to his lack of supervision over his workers,he's willing to see this 18yr old boy lose his future rather than neg a compensation with my frd... My frd has already consulted a lawyer to enquire abt his rights/claims...The lawyer says he can sue the shop for negligence....hope it'll turn out ok for him. But my sympathies to that poor boy....granted he has no right to take my frd's car for a joy-ride,but imagine the BOSS sacrificing him in order to "siam" compensation...and yet,the same shop can spend huge amts of money advertising on Highway and other car magazines... I can only say this....we'll all looking to make $$$, but not at the expense of destroying a youth's future....hope this guy will get his due justice soon...IN COURT! The shop is liable for all actions of its employees during the course of their work. The company must ensure that customer's property, that is placed in their care, is given due care. Car owner can sue the shop for negligence and claim the damages. 2. The boy may not be liable for damages if he is employed by the shop and was on his tour of duty. However, he will not be able to escape the civil suit, ie, Gahmen charge him for driving without license and causing accident. He will have to pay all damages to Gahmen's property (eg, lamp posts, road signs, traffic lights, etc, which were damaged). Link to post Share on other sites More sharing options...
