The article is saying that pedestrian has similar duty of care as a jaywalker while crossing controlled junction.

In this case, the pedestrian saw the oncoming car and continue to cross.  Pedestrian bears part of the duty of care.

That's why the driver get a way with a lighter sentence despite trying to conceal his wrongdoing.

Driver or vehicle confirm lose no matter what.

But it show clearly there are liability on the other party also. Which is why in some cases the driver dun get the full or max punishment.
