When Japanese authorities arrested former Nissan CEO Carlos Ghosn on November 19, prosecutors asked for the maximum detention time of 10 days.

After the initial period expired, prosecutors asked for a 10-day extension. As a result, the executive’s release was expected to take place on December 10. That might not happen, though, as a new report from Japan claims Ghosn’s detention will be extended until the end of the year.

The Sankei newspaper cited unnamed sources who claimed Tokyo prosecutors plan to arrest Carlos Ghosn again on a fresh claim of underreporting his income. If the report cited by Reuters is accurate and authorities approve the maximum detention for that case, the former chairman of Nissan would remain in custody until December 30.

Initially, the Brazilian-born businessman was arrested on suspicion of conspiring with former Nissan Representative Director Greg Kelly to understate his compensation from 2010 to 2014. Prosecutors said Ghosn hid about half of the actual 10 billion yen ($88 million) he received as pay.

The fresh charges reportedly cover the same crime committed from 2015 to 2017, when the suspects allegedly underreported Ghosn’s income by about 4 billion yen ($35.4 million). The former executivehasn’t been able to respond to the allegations, although public broadcaster NHK said he denied them. The Tokyo prosecutors’ office declined to comment on Sankei’s report.

Under Japan’s laws, crime suspects can be kept in custody for 10 days and the period can be extended for another 10 days if a judge approves a request from a prosecutor. At the end of the period, prosecutors must file a formal charge or let the suspect go.

However, prosecutors can arrest the same suspects again for a separate crime, in which case the process is repeated. It’s not uncommon for suspects to remain in detention for months without formal charges and without bail.

In a surprise move, a court in Japan has rejected a request to extend the detention of Nissan's former chairman Carlos Ghosn, paving the way for his release.

Mr Ghosn has been charged with financial misconduct - accused of under-reporting his pay package over a five-year period.

He was arrested in Tokyo in November after the allegations first surfaced.

His detention could have been extended on separate charges until 30 December.

However, in a shock decision the Tokyo District Court said on Thursday it had heard the prosecutors' request to keep Mr Ghosn in detention, and had rejected it. The move means he may be released as early as Friday.

The court also rejected an extension to the detention of Greg Kelly, an aide to Mr Ghosn.

Mr Ghosn, a towering figure in the auto industry, has previously denied the accusations made against him.

His defence team has said they are invalid because they do not relate to his salary, but to future payments that he was expected to receive after retirement.

Japanese prosecutors have also charged Nissan in relation to the case, which has continued to send shockwaves through the global car industry.

If Mr Ghosn is convicted, the charges could mean up to 10 years in prison. The charges also carry a fine of up to 700m Japanese yen ($6.2m; £4.9m), according to the Japanese regulator, the Securities and Exchange Surveillance Commission.

Mr Ghosn's detention has also put into doubt the future of the Alliance - a global carmaking group that includes Renault, Nissan and Mitsubishi.

Nissan and Mitsubishi both sacked Mr Ghosn as chairman after his arrest last month.

But Renault has held off doing so, choosing instead to appoint a temporary deputy chief executive to take over the running of the firm.

ghosn balek kampung. He's lebanese to begin with so will stay put.

The Japs will hate this. People who know will say their justice system sucks big time (u 'suspected' of doing something wrong, u disappear for 23 days, and if they can't prove it, u get released and rearrested on another charge and disappear again) but to publicly rebuke them on this will mean they will send ninjas to lebanon.
