Same insurance company, of cos they will give the excuse if t isn't clear. Why go through the trouble of left pocket out and right pocket in. Doesn't matter if the other party ran a red light since there is no video to proof. Since you are making a right turn (I presume a discretionary right turn) and are there street cameras around that area? If so, possibly a police report will be required to review the footage to determine who is right and wrong. This is provided TP decides to investigate. Otherwise, just want to settle the case, what is your insurance Excess? Typically if cost of repair is more than Excess, pay the Excess and claim OD, and move on. As for the third party claim against you, I'm pretty sure if your insurer tell you to settle yourself, they would have told the other party the same as well.
