Yes is insurance pay. Imo, totally justified. Her apache career totally gone becos some f**ker cabby decide to beat red light. Pui

Ya. I agree. Usually, when someone claims future earnings, I read it with a pinch of salt.

 

However, this case, she is a apache pilot and her potential as a successful combat and or commercial copter pilot is really lost as a result of that particular accident. Totally justified IMHO.

 

Also, how is she at fault when she was riding in a taxi.

I believe it is duo functionality. I know that the machine gun is linked to the pilot's helmet. It turns as the pilot turns his/her head. So no need to move the joystick just to fire off. Just turn head and fingers on trigger to fire off.

 

I am no pilot. Just a enthusiast with remote control helicopters

 

Yah both seats in the chopper should have control of everything in case one of them is injured. Anyway flying a chopper is definitely never easy.

The amazing thing with a heli is the controls. There is no lefthand or righthand drive like in a car. The two front seats have exact same controls. Left hand is always collective with throttle and right hand always joystick regardless sitting on the right or left side of the heli.

Apache is classified as an attack helicopter (Ie. akin to F16 fighter jet) with anti-tank capabilities. Saw a discovery channel 1hr feature on it. Totally impressed with the technologies and capabilities.

 

The operations and controls are much more sophisticated than any recreational helicopter available in the market.

The operations and controls are much more sophisticated than any recreational helicopter available in the market.

Also to add, ours is the more advanced version, the AH-64D and not the barebones AH-64A or AH-64C. Much more sophisticated and capable. Also means a lot more electronics.

Personal accident insurance already there is a limit to payout in terms of various disability. But in the pilot's case, it is not disability as she can still perform the daily activities of living as normal human being but just that the fine dexterity and coordination required for her specialised role is lost. Those are not covered by personal accident insurance.

 

That's why she has to start a civil suit against the cab driver.

There's generally no limit on liability for death and bodily injury to third party in motor insurance policies. I guess she has probably been unable to reach a settlement with the insured's insurance company to her satisfaction, and so is filing a civil suit against the taxi driver, so as to have a court hear and pass judgment on her claim. She is likely aware that even if she were to be awarded by the judge the full amount that she claims, the taxi driver may not be able to compensate her enough to even cover her legal costs, but she may then be able to leverage the court ruling as legitimacy of the amount that she claims in furthering her negotiation with the insurance company. Moreover, a lawsuit shows that a plaintiff means business and opens door for re-negotiation and private settlement before court judgment.

A young woman of such ages deserves more coz even if she marries and child bearing would be harder due to her injuries, given such scenario, I think she deserves at least 4-5mil.

 

I'm sure she has consulted her legal side plus military medical advise to sue ' Gao Gao ' since the other party do not want to contest.

Next time when ferry customer, can taxi driver check what is their job/status? If a high income earner, can dont pick up?

This case came up controversial because of the large potential earnings being factored into the claims. I agree that the pilot should get what she asked for.

 

I am just wondering......if say one of the non-mediocre >$1mil PA elite ministar gets into a RTA because some taxi driver beat the redlight.......What will be the lifetime claim amount?

 

$30mil? $50mil (including potential bonus and pension) -_-

They use mouth for speech more than using limbs, more brain to think than ĺegs. unless affected cognition and speech, don't think it's going to affect a minister ability to do his duties.

 

 

But for occupation like pilot that require cognition, speech, pyschomotor skills and fine motor skills, any bit will affect the occupation.
