you are right. if during routine check before flying, some cracks found on the plane body but pilot knowingly still chose to fly, then he should be responsible.

This is on the premise that the plane was fit to fly in the first place.

In such an example, Imagine the pilot later discovered the plane design was flawed, the air worthiness cert was blindly rubber stamped. The plane could not last more than a few landings. I am not saying pilot no fault, but he’s getting a raw deal here.

Design QP charged for failure to check design assumptions. This is similar to cause of nicholl highway collapse.

 

AC checker failed to perform original calculations.

 

Clearly a design failure. Charges no mention anything about construction shortcuts.

 

so lucky it collapsed now instead of later when vehicles were on it?

A life was lost and many injured. Engineering is not about luck. Only the beam was in place. The road deck was not even cast yet. Imagine hw far off the calculations were.

OKP and LTA are damn lucky, as this piece of news was overshadowed by the Thai Cave Rescue some 2 weeks ago... [furious]  [furious]

 

 

SINGAPORE: The Land Transport Authority (LTA) has reached an agreement to terminate its contract with Or Kim Peow (OKP) Contractors to build the Pan Island Expressway (PIE) viaduct that collapsed last year, said Transport Minister Khaw Boon Wan on Monday (Jul 9).

 

In his written reply to a parliamentary question by Non-Constituency Member of Parliament (NCMP) Dennis Tan, Mr Khaw said besides terminating the contract, LTA will also recover the appropriate costs from the construction company.

 

He added that the agency will engage a new contractor to complete the construction of the viaduct from Tampines Expressway (TPE) towards PIE (Tuas) and Upper Changi Road East, as well as the rectification of any structures which are deemed unsafe by the independent Professional Engineer.

 

"The project timeline and completion date will be reviewed, after the award of the new contract," Mr Khaw said. The project was scheduled for completion in 2020.

 

In a separate press release on the same day, LTA said it will call for a replacement tender later this month, and plans to award the contract by the fourth quarter of this year. The indicative completion date for the project is the first half of 2022, it added.

 

The incomplete viaduct collapsed on Jul 14 last year, causing the death of Chinese national Chen Yinchuan who was one of 11 workers on top of the structure before the incident. Another three Chinese, one Indian and six Bangladeshi workers were injured too.

 

A multi-agency probe into the collapse found that corbels - brackets that help support beams - had given way. Cracks were also found in the areas supporting 11 other parts of the viaduct.

 

In May this year, OKP Contractors and five individuals - including executive director Or Toh Wat - were charged under the Building Control and the Workplace, Safety and Health Acts for their roles in the incident.

The Board wishes to update that the Subsidiary and the LTA have, on 6 July 2018, entered into an agreement to mutually terminate the Contract, with effect from 6 July 2018 (the “Mutual Termination”). The Mutual Termination is expected to have a negative impact on the earnings per share and net tangible assets of the Company and the Subsidiary for the current financial year ending 31 December 2018.

 

So OKP manage to walk away without the need to pay any penalties? And rectification work to be done by the next better player??

ok la, at least OKP not going to continue with the work. hopefully the next contractor coming in can do a full detailed review of the existing structure before continuing with the works.

This answers your question. Its not so simple as just walking away. Whoever bids to complete the project is likely to bid at a premium because much time is needed to first document then pick apart what has been done/needs doing/etc. before completing the job. This cost will likely be charged in part if not in full against OKP. Even liquidated damages are likely to be levied.

Site work had been stopped for so long that it is virtually guaranteed that project completion will be delayed.

yes, project completion will be delayed but as of today, not gone beyond original Time for Completion yet. in any case, point moot when mutual termination comes in.

Valid point, but it would be shortsighted and a dereliction of fiscal responsibility if OKP is allowed to create a mess, NOT have to finish the job, and walk off without making good the nation’s loss.

 

Between our viewpoints it is just speculation for now; let’s see how this plays out.

Hmmm...

 

The new contractor might have to demolish the existing supporting pillars if they are structurally unsafe.

Still can meet 2020 deadline?
