I would be most glad to shift and let the taxi drive out and take the lot. Then I'm free to do whatever I want instead of standing there to make sure I won't get summon.

 

A little bit of common sense would have make this argument unncessary.

Taxi would have honked & waited for quite a while before the Lancer driver appears. That contributes to Taxi driver reaction & exchange of words. To taxi drivers, time is money. Obviously, it's the inconsideration of the Lancer driver. However in the eye of the law & insurance, the Taxi driver is wrong because thaere is video evidence to show he knocked in the Lancer.

 

Taxi driver could have call the hotline & let authorities fine or tow Lancer away.

 

ps. Is the Lancer a PHV ?

TP won't get involved as no injuries, no damage to public property/foreign vehicle.

 

Insurance-wise, think is case of moving vs parked vehicle, thus moving vehicle will lose,

don't think it matters whether parked vehicle is legally parked or otherwise.

 

If you classified as Hit And Run, TP will be involved.

After what you wrote, I re-read the article....you are right, the report is ambiguous and non-committal to the exact number of people involved.

the reporter probably not sure him/herself and tried to smudge it over.

 

Such is the quality of our local journalism.

 

I am not sure which one should be more worrying.

 

Their lack of integrity or their inability to write properly.

Liddat taxi man also will not report insurance and Lancer driver LLST cos his insurance cannot claim taxi insurance cos taxi man didn't report. Lancer driver got to engage own lawyer if want to pursue. Lancer driver squeezed balls .......

Quite skillful also. How many drivers able to turn out such small space.. And the taxi driver turn out just nice. If I am the driver, I don't think I am able to turn out without causing more damage the the parked axio or the lorry beside.

Under the law of easement (which applies to the right of way) the silver car will lose his case in court if he litigates - by stubbornly refusing to give way and thereby causing hardship to the taxi driver (e.g. the opportunity cost of not being able to ply the roads, to earn his due fares) ... while the taxi driver will probably be charged with an act of mischieve, albeit on a mitigated sentence - due to the aggravated circumstance.

 

Lose-lose case lah.

 

As someone else mentioned, it would have turned out much less acrimonious, if the silver car had allowed the taxi to drive away, and he then, take the latter' parking slot.

 

Silver PHV driver also will get charged with act of mischief? Since he also kicked the taxi. Can taxi driver say he never stop to exchange particulars cuz he felt threatened by the silver car driver when the guy kicked his taxi?
