Finally, Judge who applies the Woman Charter Fairly

Whilst the case in question is about 2 people with comparable earnings and above the median $2000 in Singapore, I would like to think about what justice is for those of the lower half.

 

their suffering is definitely disproportionate due to how meagerly they clear the poverty line due to our high cost of living.

 

If both man and wife if earn under 2k, family court will STILL force man to pay alimony. will judge consider circumstances like in the above case? Man gets kicked out of house and still services mortgage and woman has house and gets alimony and earns her own money? sounds ridiculous?

 

If man earn under 2k and wife doesn't work, family court will DEFINITELY force man to pay alimony. No discussion. Not even after the wife start working. Man gets kicked out of house and still services mortgage and woman has house and gets alimony to do nothing.

 

Both cases consider no children to simplify things. And once Alimony is set, I don't think it will change unless man earns more and woman finds out and apply to increase alimony, or woman married again and man have to apply to strike off alimony, and I hear that the woman has to agree to the strike off of alimony. Incredulous...

 

What you had just mentioned is precisely the reason why the Women's Charter will have to be re-looked and re-balanced.

 

The issue here is not so much about their income levels, but rather their circumstances. Like in the example you mentioned, if the man have to be kicked out of the house with an outstanding mortgage and an additional alimony that he has to service, this is already injustice. You are already forcing the man into a corner, of course this is provided that the woman has the ability to earn the same.

 

In this unfortunate case, a Man's Charter will be more applicable instead.

Totally agreed !

Woman chapter is applicable when the woman is really a housewife with no income, and depends on his man to support. And this is where woman chapter come in to protect the woman rights, and Aware should be fighting for these woman.

 

But, woman chapter should not be used to penalize man, when the woman is earning more half of his man's pay. This is becos, after giving maintenance, the man is basically left with nothing. We can't penalize man like that, as marriage is broken down betw these 2 parties. Having said this, if man commits adultery, then I think there should be some penalty to pay to woman.

 

Last but not least, whether woman chapter comes in or if there is a new man chapter, ultimately when marriage fails, children suffers. Though money is for the maintenance of the kids, however emotions of the kids will be affected. It will be good for both man and woman to assure their children that they still love their children. We just want our children to grow up healthy, physically and emotionally.
