Car Accident: Who is at greater fault?

I will say again that I was outside the taxi stand area. I.e. I was in the left most lane. Taxi stands are for taxis queuing so I was not in the taxi area but outside. I dropped my friend off with my vehicle in the lane (double yellow line). IIRC, immediate drop off and boarding are allowed on double yellow line.

 

Just because immediate drop off and boarding are allowed on double yellow line, doesn't mean it is safe or you have the exact right to do so.

That particular road is congested due to the poor traffic control with the bus stops, carpark entrance and taxi stand cramped together in that 100m.

 

There is a drop off and pick up if you drove into the mall carpark entrance, you don't get charged for anything and all you have to do is to make a U-turn after you exit the mall. If you can take the trouble to drop someone off there, it isn't too much trouble to head into the mall's pick-up/drop off.

 

You did not indicate whether you had signalled your intention of moving off from stationary position, the other driver would have assumed that because he is at a faster speed than you, he should have over taken you to move into your lane then enter the mall carpark entrance. You having moved off from a stationary position, you should have signalled your intention to move off and checked your mirrors for any vehicles regardless your right of way.

 

As another bro here have stated, drivers familiar with that area always avoid the left most lane because it is always bottlenecked with drivers dropping off and picking up passengers, not mentioning the taxi line waiting to enter the taxi bay. These factors cause situations when drivers who want to enter the mall carpark, having to cut from 2nd lane to 3rd lane into the carpark, in an almost simultaneous single move.

 

Judging from your photo, it should be considered 50-50 unless you can prove the other driver was reckless beyond doubt.

There is wad, i normally drop people at taxi lane then wait behind taxi to pick up passenger before i rejoin into the 3 lanes

After looking at my pictures and google map street view, I clearly was not in the taxi bay. I was in the normal lane. 50-50 it is then. Thank you everyone for your input.

So please tell me, if a car behind u needs to get into the carpark, do u expect him to wait behind u to finish dropping off your fren or overtake u n enter the carpark?

I am guessing TS is one of those who only care about his liability in such situations, not overly concerned about considerate behavior...

 

Like I said, I feel aggrieved for the other party instead.

hate that place ... so many car make quick dash stop in front of clementi mall

lane 1 and 2 will make quick dash to cut in last minute

that place is just accident waiting to happen

Have encountered similar situation before. Most likely 50/50 since you no video. I got video showing the guy cut into my lane also 50/50.

 

Their reasoning was because I am moving off so I should have watched out for these kind of cars who are going to cut in to let people off also.

I don't feel bad for him and his rental car. In fact, upon closer observation of the other photos I have taken, my car was beng rammed into and not the other way round. After the impact, my car which was initially straight became tiltled about 20 degrees to the left. Not trying to calculated the momentum or any physics formula here. Disagree if you must but I feel that I am really an unfortunate victim. That being said, I will never drop someone off around Clementi Mall area again. Not worth the risk if I meet some driver like him who do not know the difference between calculated risk and recklessness. Just an unlucky day for both of us.

Aiya both at fault lah.. 1 did not check right mirror and 1 did not practise defensive driving

 

I got experience many like TS before.. Taxi stop a few metres before my carpark entrance and in order for me to turn left to the carpark, I have to go to the 2nd left lane to overtake the taxi. But as I about the pass the taxi to overtake and change back left lane, the CB will move off without looking at the right mirror as he thinks he has the "right of way" since he is in the lane.. So he wont notice my left signal.. Me already anticipating such scenario, always prepare my foot on the brakes to prevent any accidents like what TS encountered or " unintentionally caused"

 

So a few questions for TS:

1) Did you check right mirror before moving off?

2) If you did, was the toyota's left turn signal on?

 

Anyway, if I were the car dropping the passenger, I always ensure that the right lane beside mine is clear before even inching forward..
