Long story cut short

 

Bought a second hand ride a few weeks ago from creative auto. Deal and price was reasonable , so proceed for checks and inspection. Car is both inspected in STA and Agent

 

In both reports car condition is satisfactory

 

 

Went for regular servicing , workshop found out a leak in fuel tank causing a strong petrol smell. Quoted 2.7k to replace the whole fuel tank.

 

Informed dealer about this issue , dealer giving bo chup attitude quoting my driving style damaged the fuel tank and saying he has both STA and agent's report to support his claims of saying vehicle was in good condition upon delivery

 

 

Went down to case , they recommend to bring this case to small claims tribunal

 

Question is

 

Is there any chance to win this case if I bring it up to small claims tribunal?

Is this covered under the lemon law?

This is something that is bothering me too. Clearly seen it has been there for awhile. Getting extremely bad FC and stains too

Surely the dealer isn't to blame in this case since 2 independent parties have inspected the car on your behalf.

 

Their concern is legit - how do you prove that the damage had already occurred at the time the car was purchased?

Under the Lemon Law, if a defect is detected within 6 months, it is presumed that the defect existed at the time of sale or delivery and the lemon law provisions apply, unless the seller can prove otherwise

 

- Now Seller is able to prove otherwise as they have 2 independent parties report in their hands

 

 

In this case , on the next used car purchased do not send to for inspection?

When u say agent does it mean the AD? then u go workshop to service is not the AD?

If yes, hard to win... AD oso certified ok wifout fuel leakage...

Yes , the initial inspection is by both AD Agent and STA

If satisfactory at Agent, a bit hard to fight for it.

 

But still can try at small claims. It's cheap to file a case.

How do you know? Maybe can get your workshop to back you up.

 

Hope you win the case. Btw you bought the car how long then you realised?

Doubt lemon law apply for you cuz already have 2 different inspections/tests already. The dealer got proof that when they sold to you there was no problem.

Take the two reports.. go to the inspection centre to get an explanation.. if it is there for sometime....be smart...go to another inspection centre like vicom ..to get a third report....note down how long the leak was suspected...this will.mean they failed their task in certifying the car is road worthy...a leaky fuel tank is a fire hazard so they have a lot to explain... did the dealer cheated with them or what....? Go bang some table...get a lawyer view if needed...in USA.. such certification failure can be sued....
