Red packet = Corruption?

If it's chinese new year period, and your customer/contractor gives you a red packet with $$$ inside..

 

It is considered corruption under the law to accept it?

Correct but this is also a grey area because of Chinese customs they tend not to look into it unless something happen or someone blow whistle.

That means those who work as civil servant, can hold birthday parties for their children but cannot accept any gift.

It bad to work in govt sector

then you give him 2 mandarin oranges lor... or better still, give him a red packet too (to return his "blessings", be it real blessing or otherwise)...

 

actually regardless whether corruption or bribery, i think more importantly is whether did you feel obliged to help, or have helped him (do something)... so as long as still do things by the process, then it should not be treated as corruption or bribery...

 

and of course you may lose this customer/contractor for not "helping" him, but it is better to lose this customer than to do something wrong and live to regret thereafter....

depend on company policy.

 

some company allow their staff to accept gift until certain amount.

 

some company if they declare, company allow them to keep it.

its depends on the $$$ inside. I dont believe that the authority would take action on a case where the contractor giving the customer child a $10 red packet during CNY... but if its a few hundred dollars red packet (not to mentioned 4 or 5 digit).... what do u think??

Give to children?? How much did they give?? 1K?? 10K?? or just a $20 to $30 gift??? if less than $50, you think anyone is so free to investigate?? its all by common sense lah.

Normally MNCs will have rules stating whether it is permissible to accept/reject it.

 

But SMEs is more unstated..,

 

Furthermore the grey area here is red packet, not an outright monetary reward or personal gains

I believe it is alright if you got no idea: What is inside. How much is inside. No way to identify/trace the donor later. I never open any of them until years later when I really got no idea who donated which one. Ever returned the cash inside to the contractor!

Ever told the bribery performed by the civil servant's wife with the other party's wife is not illegal or corruption? Some promotions soon followed?

I heard the same thing....but thats in our neighbour countrty. Some high rank police officers ask their wife to join those MLM or insurance company. Then ask those bookies, loanshark & etc buy insurance / MLM product from their wife (or wives). By doing that, they are not only making the bribery legal and also laundry the money so that they can buy stuff without worry being caught.
