And your source for this assertive statement is? Your interpretation, or what an actual judge in Singapore actually wrote out in his post-trial report or explained during a court session? If unsure, please do not make such interpretations of the law with authority - you might mislead many innocent and misguided souls into getting their licenses KANTONG!

It is LEGAL to use the handphone when the car is stationary.

 

2. What constitute handphone driving?

To ensure that only drivers who blatantly disregard the safety of other road users by using their mobile phone while driving, 3 clear conditions were stipulated. For the offence of handphone driving to stand, ALL the following 3 conditions must be fulfilled:

 

(a) the vehicle is in motion; and

 

(b) the driver is holding on to the handphone with one hand; and

 

© the driver is communicating with any person with that handphone.

 

[Para 2© includes making phone calls, paging for someone, receiving a call by pressing the keypad, reading, writing or sending of SMS.]

 

The purpose of setting the 3 conditions is to ensure that drivers who have no intention to commit handphone driving will not be caught by ambiguous rules. For example, a driver who simply holds a mobile phone but is not using it to communicate while driving will not have committed an offence of handphone driving. However if by doing so, the driver loses attention on the roads and fails to maintain proper control of his vehicle, he will still have committed an offence of driving without due care or reasonable consideration.

 

Similarly, the spirit of the law is such that the driver who uses his handphone is only a menace to other road users if his vehicle is moving. As such, drivers who use their handphone while the vehicle is stationary should not be caught by this rule.

 

In short, Traffic Police do not take action against motorists for handphone driving simply because there is a handphone on the passenger seat or beside the driver. Traffic Police will only take actions when our observations show that all the three conditions for the offence of handphone driving are concurrently present.

But at least she stop and text. I also do that sometimes, but well.. I admit i should't do that. [laugh] [laugh]

She was not wrong to text when her car was stationary.

 

But she was very inconsiderate not to continually look up to see if lights have changed and other vehicles ahead have started to move, and be quick to stop texting, put down her handphone and concentrate on driving!

My understanding is that texting when the car is not in motion is LEGAL.

What I remember reading in my BTT long time ago is when you are on red, you are not supposed to do even things like reading maps. You should observe the sorrounding!

Thanks for the comprehensive & correct answer.

 

On the other hand those who tend to text whilst vehicle is stationary waiting for change of traffic lights must be more considerate.

 

Once during peak hours I was behind a SUV on second lane from right Paterson waiting to turn right into Orchard Boulevard. When most vehicles on right-most lane were moving of, that car still did not move. When I had the chance to signal and move to right lane annd pass that SUV, I realised that the lady driver was not held up by anyone; she had been engrossed in texting on and was not occasionally looking up to see if traffic lights have changed and vehicles ahead has started to move off. How inconsiderate she was to other motorists who have to stop again when lights turn red.

 

Please do not be like her.

Maybe you can do anything you want but you must constantly observe the surrounding. :D

im surprise many drivers like you are still clueless..

 

and for those who think that is not an offense holding to their hp and using speaker mode to communicate..please read it up

That pretty much contradicts the reasoning the AG have been using all along in prosecuting individuals who were under the influence of alcohol, and resting within a stationary car (note that engine was not even running, key was not in the ignition).

 

Well I stand corrected, and thanks for quoting the source, but it definitely goes against the grain of what I've been used to so far. a good change I guess.

as long as the car is not moving, u can do anything.

 

but once u move, drop everything and focus on the road

One can be prosecuted while resting at the side of the road when drunk, even when the engine is not running? If parked at the side of a main road, I believe it's possible. But if parked in a carpark lot at the side of the road, they cannot prosecute the person right?

 

No problem, I only found out abt it after I researched on SPF website.

I said illegal cos I once saw a driver being asked to pull over texting/dialing @ junction. TP was beside his car.

even in carpark, when the engine is on is considered illegal, my friend got his phone confiscated in ubi carpark.
