Based on the video....

 

BMW driver last minute signal and filter to try to exit. BMW underestimate the Taxi by assuming the Taxi will either give way to him or his BMW will outrun the taxi.

 

Taxi may seem to have accelerated in the video but it's not true, if you see carefully it's the car with video slowing down.

 

The BMW is potentially in the blindspot of the Taxi driver, giving benefit of doubt the Cabbie may not have noticed him to give way.

 

The BMW driver must be trying to concentrate to cut in front of the taxi and he last minute then see the divider....luckily he manage to evade it or this will be even hotter than the pothole case.

 

The BMW driver should have filtered behind the Taxi since there's alot of space.

 

98% BMW had it coming.

2% Cabbie for not aware of his surroundings...

I think He is trying overtake the taxi but never know there is divider in front. Count him lucky manage to avoid collision.

That's me slowing down because I was so sure he's going to hit the divider. Mind you the road is wet and chevron markings aren't particularly known to give good grip.

 

If my car gets damaged from his flying parts, do I get to claim his insurance?

In this case, it's not a matter of ego. It just show that the BMW driver has got lousy judgement that's all. For any wise driver, he/ she would have slowed down and filtered behind the taxi.
