Koh Seah Wee of SLA fame got 22 years for 12.5million. I would put James Phang damage more severely to public than Koh's. A sentence of 30 years would be more appropriate. The message to such people will be you will never see the daylight again to enjoy the spoils. Yes he cheated individuals. Nearly all financial scams exploits the victims' greed and gullibilty so that does not make the perpetrators any less responsible for their scheme. If so, we are setting a very dangerous precedent for other cases that follows i.e to allow the severity of the punishment proportional to the victim's greed or vulnerability. Going along the same line, SLA as an organization was negligent that it allowed 2 of it's executives to make off with such a large amount of money over a long period of time. Does that make the crime of the 2 person involve less serious in anyway? It is just like if you leave your door opened, then the burglar's defence will be that the door was opened anyway, therefore he is less guilty. Apparently, we know that it is not the vulnerability of the system that determines the level of responsibilty a person should bear in white-collar crimes. For the action of James Phang, numerous families and friends are wrecked directly as a result but in the SLA case, the impact is not so obvious. Therefore, I think that 9 years for James Phang is woefully inadequete both as a punishment and deterrent to future scammers. A sentence of 30-40 years will make sure most of these potential scammers will not live to spend their ill-gotten gains even after they serve their time. I totally agree with you and beyond that, alot of the victims are not purely lulled by financial gain. A first batch of "market aunties" were employed and paid to spread the word amongst their friends. Cheating educated white collar workers with such idiotic projections is one thing, making use of the elderly AND the young and gullible is a whole new different level. This James phang is a bigger coward preying on the old folks. At least those fools conned by madoff are supposed to be the la cremme de crop, highly paid financial gurus and/or successful people in their own rights.
