Normally you will see in the contract that in the event that you resigned without giving one month notice you will need to pay the company one month salary. Do the company normally will pursue this if the person left without notice and didn't pay the salary for notice? The company will just give it up and didn't pursue further most of time? Vratenza Supersonic December 16, 2016 Share December 16, 2016 if the person salary is $2000/mth and the lawyer/court fee add up to $10,000..... even if the court rules in company favour and ask the former employee to pay for the cost, it is too time consuming (read: man hour cost) for the company to pursue. Unless the person is drawing > 10-20K/month ...but at such level of salary, the position and responsibilities will usually be at least 3 month notice. Don't ever bet on this. It really depends on the boss and company. Then, see the wind flow, see what they wanna do - pay u to go immediate, serve out full month, sign indemnity letter saying u go immediate w/o compensation from employer (yes, seeing this trend coming up also). As it is we are scraping the barrel with no projects in sight and yet we have to deal with this sort of underhand stragety. If they had hired a local I would have been happy as most locals who applied were my kakis as well. so how are you different from the FT who hired FT? Unless the person is drawing > 10-20K/month ...but at such level of salary, the position and responsibilities will usually be at least 3 month notice. boss. no need go court or get lawyer. usually get a representative go to small claim court. before going to court. they will assign a mediator or judge to trash things out. if both parties agree to settle out before going small claim court then settle. but if the party at fault agrees to pay but refuse after leaving court. the company or person can take out a court order saying the party refuse to pay as agreed. after which the court would tag a flag on the person. in normal times. the person can dont pay but should the person wants to apply a credit card. take a car loan or housing loan. the banks will know that this person has a judgement against him and he has not paid up. thus this person can't buy anything that needs a loan. he would need to pay up to the party he defaulted and the company would proceed to small claim court and dismissed the judgement against him but the damage has been done to the person as this record would be tag to him for 3 to 5 years. unless he follow the china man kan caught for using fake passport and changing name . he needs to pay up. even if you change your name. you cant change your id number 3 Link to post Share on other sites More sharing options...

If you are already working then they will keep your money as compensation. So if you are running away, wait for the salary to be bank in first then don't turn up for work the next day. However are people so irresponsible these days to sign appointment letter and never join or just run away from company without serving notice? I really hope so.
