Car hit by fallen branch: TC's contractor refuses to pay because it's 'act of God'

STOMPer Super's car was damaged by a fallen branch, but the contractor responsible for maintaining the trees in Woodlands Drive has refused to pay, claiming that the incident was an 'act of God'.

 

The STOMPer said:

 

"This incident happened in April 2011.

 

"I parked my car at the unloading/loading bay in front of my block in Woodlands Drive to fetch my son from school.

 

"I returned with my son to see horrible damages to my Honda Civic.

 

"The windscreen and many parts of my car was hit by the fallen tree branches.

 

"After so many months of my insurer trying to claim from Sembawang Town Council's main contractor for the maintenance of trees, their insurer has refused to pay.

 

"As a result, my no-claim discount decreased from 50% to 20%.

 

"What is this? They even told me this was an 'act of God'.

 

"It was not even raining or there was no strong winds that day.

 

"After the incident, the trees around the area were trimmed.

 

"If nothing had happened, they wouldn't have trimmed the trees.

 

"Imagine if the branches had hit my son, what will happen then?"

Just bad luck but still lucky compared to these people...

 

20 Jul - 15m-tall tree came crashing down on Mr Chua Loong Wai's car while travelling along Yio Chu Kang Road towards Upper Thomson Road. He died on impact.

 

15 May 07- Ms Ho Siew Lan, 42 crushed by fallen tree at Bukit Batok Nature Park

 

31 May 07 - Mr Nguyen Ngoc Quang, a Vietnamese in his mid-20s, was killed by a falling tree branch. The incident took place on the Petaling Trail that leads from the TreeTop Walk.

 

25 Apr 09 - Mr Noordin Osman, 46, a landscaper, was killed when a 20m-long branch fell on him at about 10.30am. He was doing upgrading work at the Pyramid Club in Goodwood Hill when the 15cm thick branch snapped.

He's waiting to do "loading" his son into his car mah. :D

 

What he did not expect is the tree "unloading" its branches onto his car. :D

 

Hence "loading & unloading" bay.

typical complaint wants to use kid as example. sg is full of tree and its hard to pinpoint falling branches. just avoid parking under tree.

I have a suggestion that would help him recover the cost and at the same time make him a millionaire. Devise a method or a test to determine whether and which a tree or branch would fall in between pruning period. Then patent it. Based on stomper's comments it should be simple and obvious.

Recently also got 1 cab kena a big tree along Tiong Bahru Rd but luckily the driver only suffered cuts to his arms.

Still lucky, REALLY unlucky ones are all lying their coffins. [bigcry]
