Help! Last car in chain accident, but insurance void!

Hi dear forumers,

 

I would appreciate whatever advice there is. Thanks in advance!!

 

I was involved in a chain accident, which I am the last car out of 3 cars.

What happened is that I rear-ended a Swift when we were moving slowly (around less than 20km/h) along ECP towards east side.

The Swift's rear door was dented in, but there was not much damage to my car except for a slightly folded bonnet and cracked bumper.

 

In front of this Swift was a Lancer, which had the rear bumper dented as well.

It is not clear who banged into who first, but I was quite sure I had kept a safety distance from the Swift.

 

The thing is, after I reported my accident to my insurance company, and wanted to claim from my company, it took them 7 days from the day I reported to check on my Driving License Date, and voided my insurance 7 days later, stating that I did not satisfy one of their criteria (minimum 2 years driving experience). Problem is, when I purchased their policy, there was no way I could enter my Driving License date!

 

And now the Swift driver had her car repaired, and she tells me that I have to pay for the damage for the Lancer as well. And the damages are not cheap !!!! Amounting to $8000+++ including the rental fee of $120 per day.

My questions are:

 

1. Can Fidrec help to at least ask my previous insurance company to honor at least partial of the claims? My insurance company is D*****A***

 

2. Do I really have to pay for the damages to the Lancer?

I found this BOLA from GIA link (see page 9)

but I'm not sure since my insurance has been voided effectively during the accident. Anyone else in a similar position but still escaped paying for the first car's damages?

 

3. Is there any way to settle the charges with workshop without seeking approval from the Swift driver? She doesn't seem willing to let me settle with them.

 

Any help rendered is greatly appreciated!!

Not possible for you to get a quote without an insurer asking for your driving experience.

 

Either the insurance is purchased under someone else like your father or you simply input a figure without thinking of the consequences.

 

If your father bought the policy, most covers will include authorise drivers and at most impose an additional excess for unnamed, young or inexpeience drivers. However many covers now exclude all other drivers except the one that purchased it or it could be subject to covering those only above 35 for example.

 

Looks like you have to settle pit of pocket. Go plead with the other two vehicles to settle privately, you can save quite a bit.

Who agreed to pay the repair cost of over $8000 in the first place? If they ask you to pay, did they inform you of the cost? If your insurer agreed to the cost, then your insurer should pay.

When you buy insurance, there would be a qns asking how many years of driving exp you have. Don't really need the date you get your license. There is no way you could have bought from DA if you did not satisfy the requirement. A bit fishy here.

 

Anyway, don't pay for the damages unless it is ascertain you are 100% at fault. Even if you killed someone there has to be a trial. So until a proper investigation is completed, you do not need to pay yet. Then again, without an insurance company to help you, you are on your own. Get a lawyer to go through the terms of the insurance and the sign up process. If DA is deemed to be negligence and let you sign up without checking 1st, they will have to honour the insurance and provide you with cover and compensate accordingly

 

Easy way out is to pay and move on. Else, this is going to be a long hard battle. Good luck!

No mention which car hit which car first.

No mention what safe distance you had kept behind the Swift.

In the event of doubt, likely the last car gets the blame for causing the chain collision.

Do seek legal advice/assistance.

you must have enter 2yr or more of driving experience to get the site pass, then u pay them... this is cheating... of cos DA will void!!!

 

now best is to pay those 2 car yourself to close this case... then getting lawyer letter from them... which end up u will be paying more!!! or worst become bankrupt...

i am with directasia,

 

i remember when i toke up their policy for the first time last year, after all the online entry, a directasia staff did call me on my hp to confirm my policy and to answer any queries i had.

 

sorry TS, you could have told them there and then that you have less than 2 years experience.

Turbocharged

Direct Asia covers only drivers above 25yo and with >2yrs driving experience for the main driver. If you don't satisfy either one of those requirement, you can only be put under named driver (and pay additional premium)

 

I'm under Direct Asia too, and my gf can't drive my car because she is <25yo..

2. TS obviously lied or is criminally blur - DA asks very early in the quote process how long you have been driving - so on this front I am with DA and TS only has himself to blame

3. Why must TS "agree" to the repair costs? That is also stupid

4. Perhaps most importantly - Swift only a few hundreds of dollars to repair, but the car in front $8,000 ++? Something sounds fishy here - why would the first car to be hit have some many orders of magnitude LESS damage than the car it was shunted into? That is counter intuitive and I would think needs more investigation.

I don't think the last car covers all the claims of the 3 cars.. The 1st car usually will claim from the 2nd car and the 2nd car from the last..

 

Anyway, it's not possible that the insurer do not ask about the date prior to commencement of the coverage.. This information is one of the vital information to determine the amount of premium and excess for all insurers..

 

If it is Direct Asia (which TS has not clarified whether it is yet), it is stated clearly on the first page you go to when you click motor insurance that

 

"You may qualify for DirectAsia.com car insurance if:

The main driver has at least 2 years' driving experience and is aged between 25 and 65."

 

So no excuse that you have no way to key in your driving license..

I dont think he travelled 20 kmh. Rear door of front car went in and his own bonnet folded. At 20 kmh, I dont think the damage can be so serious.

 

I think probably a rough estimation.. My friend had a very "BIG" accident with his vehicle moving off on gear 1 at Loyang sometime bad.. You should have seen the impact, it looks like he hit sometime at at least 40-50 km/h.. No mention of what car TS is driving.. I had an accident myself around car yrs back, the CX7 that hitted me barely had a scratch, but my rear bumper and boot lid was dented quite badly.. We couldnt have been travelling at a higher speed than 30 km/h becuz we were just moving off when the front car jammed on the brakes..

You don't have to pay for the damages to the Lancer.

Lancer will claim from Swift.

Based on your damages description, I doubt the Swift's lawyer to cook up any story to accuss you of pushing Swift to hit Lancer.

So you must stand firm that Swift hit Lancer on her own. And you hit Swift on your own.

That will limit your $ damages to Swift only.

If I am the Swift's owner, I am the one who decide how/where to repair.
