i know someone who is very rich... and his BMW got hit by a drop tree when he park there... he thinking can make some claim from there (as is a totally new car)... but end up watsed lot of money and they just show him "the tree had been regularly inspected, maintained and pruned" and end up he got to pay for all court fee and all lawyer fee!!!

and his own car repair!!!

He parked at orchard area, outside of CBD, 2 cars being hit that time?

In short YES. Has ANYBODY sued the SG Govt and won b4?

 

Have - remember that case of the NSF storeman who went into a Persistent Vegetative State, parents sued MINDEF and won?

 

With this National Parks case, we don't really know what transpired behind the scenes, so can't speculate - perhaps they dropped the idea on the advice of legal counsel who told them the chances weren't good.

 

In any case, even if this tragic case isn't redressed per se, the gahmen should still seriously look into whether they should chance this sort of thing (or even private property damage) recurring by having all those trees sprouting right next to public roads. "Clean and green" is a great concept in theory, but when there are real screw-ups occurring as a result of it, policies need to be rethought.

This one I kanna before, FT I think riding agst traffic....I checked right, moved on and the next moment, he was lying on the road in front of me...st 5+am!! KNNCCB! Lucky he was ok with scratches, my hood got it bad! [furious]

A prima facie case. No liability should be involved. An analogy would be a person fatally injured by lightning while standing below a tree. In this case, the investigation should be to determine if there was negligence in the upkeep of the tree rendering it unnaturally vulnerable to falling. That itself would have to be considered in the context of what constitute a regular and an unusual environment.

yeah.....i almost same situation.

 

luckily my passenger warned me cos he can see the bugger riding against the flow of traffic on my left. i manage to brake in time! phew!

 

so what did the FT do? cry in pain?

 

i suppose u didn't have to pay him anything?

Of course there could be liability. The family will need to get lawyer who will get independent tree expert to review the tree and it's maintenance records. And a rickety tree always have room for more inspection and more pruning.

 

The above process would be shortened, more thorough and inevitably shown to be flaw if a VIP is involved.
