If private settlement is not allowed by law, then the private settlement agreement has no legal status and "victim" can still claim against ur insurance. Your insurer may then have the option not to honour the claim as you had not made the report and you would have to deal with "victim"'s insurance urself. Two weeks later when I'm supposed to return you I can flatly deny ever borrowing the money from you. Honour does not count for anything for some ppl I guess the same goes for the oter party trying to play you out now? Never encounter before though. If private settlement is not allowed by law, then the private settlement agreement has no legal status and "victim" can still claim against ur insurance. U go NTUC website, they even hv a sample of private settlement form for u to download. The impt thing is to hv black n white signed by both parties. After that, u r still supposed to report to your insurer for filing purpose n other future disputes. But then, depending on which insurer, maybe tat report can become your liability cos yr NCD or premium might be affected even u hv settled privately or even the accident was not yr fault cos I understand can still file claim even after number of years b4 it's officially closed. [laugh] I also think so, many of the insurers ady no more with Idac due to some reasons we might not know. As a guide during minor accident and for private settlement, always use a pen and paper to write down the agreed details and signed by both of you with full name nric number and veh no. Report this case to YOUR INSURER within 24hrs together with the letter. In case the other party play punk, your insurer can stand by you. AS ITS NOT A CLAIM CASE, YOUR NCD WILL NOT BE AFFECTED. Fooblack Supercharged March 7, 2011 Share March 7, 2011 yep...don't settle private..very hard lah to settle private.. think the fear of pte settlement is also one of the key reasons for the endless increase in the insurance premiums. In the end, there is only 1 winner - the insurers. i think pte settlement has its merits and avoid unnecessary lengthy procedures. If one of fearful, we can just put in down in simple writing and we can just inform the insurer that we have made the settlement (in my mind this step can be skipped if the settlement writing is clear and conclusive). If there are only minor comestic damage, I suggest we do consider settling privately with proper documentation. i have done so in the past without any backlash :) We could even make a friend on the road, damage sustained notwithstanding. Trebuchet Neutral Newbie March 7, 2011 Share March 7, 2011 I experienced just recently, that if you are involved in a private settlement and do not get black and white paper agreement with the other party, if you report the accident to your insurer, they will take away your NCD when its time for insurance renewal. Reason given was "claim reserve" in case the other party decides to claim. In the end I signed a indemnity agreement freeing my insurance of any liability in case a claim is made, just to preserve my NCD. Just a note if you're involved in an accident and think it's "okay" - it may not be. Never ever trust the other party - not even your own insurance. Ya. Private settlement is always the best, so long as both parties are gentleman about it and don't later turn around and stab the other.
