Sgnick 1st Gear January 11, 2011 Share January 11, 2011 This is something I heard b4 few years back. Many cars park illegally along the side of a road. A driver drive along the road and brushed into a few of those parked cars. Owners of those illegally parked cars confront the driver who knocked into their cars. The driver happens to be some big shot and refused to exchange particulars with those car owners. The driver instead calls in his lawyer, because he feels that he do not need to compensate those damaged parked cars, because they are parked illegally. After that I don't know what happen. So my question is, that driver got a case or not huh? Can he win in court and no need to pay the other car owners? Just because they all are illegally parked? ↡ Advertisement
Mona-vie 1st Gear January 11, 2011 Share January 11, 2011 IMHO, even veh park illegally, you still have to avoid. remember reading in FT book. something like 1.5m although we never practice it one. Thus, the car failed to keep the gap and buang, its the cars fault. IMHO, classic cases like speeding, parking illegally cannot be used as a reason. The driver has to practice defensive driving and judge accordingly in situations. Not just drive blindly.

Mona-vie 1st Gear January 11, 2011 Share January 11, 2011 I think one classic case is you change lane w/o looking properly and car on that lane buang your back. Even if that car if speeding, its still your fault cause you failed to judge his speed and gap correctly.

He has no need to pay the other owners and the other owners have no way, right or law to claim against him. 1 big law, do what you want but don't get caught. Get caught and want to sue/defend/claim, better be smart enough to know who has the law on his side. Illegal parking: Illegal. Driving: Legal Contact due to illegal parking: Illegal parker no way to claim damage as there would be no damage if he were not parked illegally. Unless got life lost or serious and permanent injury then they will look at it. Money case law win.

Hamburger Hypersonic January 11, 2011 Share January 11, 2011 Contact due to illegal parking: Illegal parker no way to claim damage as there would be no damage if he were not parked illegally. if you put it this way, then don drive in the 1st place solve all problems. knocking into parked vehicles and illegal parking is 2 different issue, and it does not give you any rights to knock into someone's else vehicle. It was single zig-zag line. There was a car behind me. He had to stop cuz I was stationary. But he signalled right and moved out but I think he misjudged the size of his car and scrapped along the rear right side of my car while overtaking me. In the end managed to claim cuz got eyewitness say that my car was stationary and he was the one who hit my car.
Moredhel 2nd Gear January 11, 2011 Share January 11, 2011 well i manage to claim for my bike when my bike was hit by a lorry yup my bike is illegal park that time insurance told me that nobody have the right to bang into another vehicle just because they park illegally You may be right. But it's a subjective thing. If the lorry's insurance has the balls, he would have fought all the way that the cause of the vehicle contact is illegal parking. He was merely travelling along a road that is meant for a vehicle his width and an illegal parker cause this width to shorten to the extent that transvering the lane became difficult due to the illegal blockage. You lucky blighter. I would have told you to sue me.

Moredhel 2nd Gear January 11, 2011 Share January 11, 2011 if you put it this way, then don drive in the 1st place solve all problems. knocking into parked vehicles and illegal parking is 2 different issue, and it does not give you any rights to knock into someone's else vehicle. =) Illegal parking can be a highly inconsiderate and irresponsible action when it causes obstruction and inconvenience to other road users to your benefit. Illegally parked vehicles who choose a spot where it doesn't hold up traffic I have nothing against. Knocking into parked vehicles is one issue. Illegal parking is one issue. Knocking into illegally parked vehicles is another. When I e-brake in front of you and take 1st and 2nd lane, my car is also stationary and you ram into me even though it's on 2 lanes. I like to illegal park there. SO it's your fault or my fault? If you say it's your fault, by all means, live your delusion.
Moredhel 2nd Gear January 11, 2011 Share January 11, 2011 Just like you cant kill someone in self defence is it? You still kena manslaughter charge? If prosecution or anyone can prove that you used excessive force even after subduing/disabling attacker. Which is damn hard to prove btw. But a nicely timed consecutive punch to solar plexus, throat and upward palm strike to nose while making it look a desperate act of incompetence and luck would negate any liability as it would merely be self defence. ↡ Advertisement
