This is on top of all their other properties in which they have previously invested and rented out etc. Even if its just $1.8 million, to many of these "famous" food bosses, its really chicken feet. Defence caught on the back foot in $240,000 casino debt case Business Times 28 Feb 2013 Grace Leong [sINGAPORE] The Republic's first casino debt collection case that made its way to trial took off yesterday, with the High Court making a pointed remark - why didn't the defence request earlier crucial surveillance video footage that would have bolstered its claim of unsolicited credit. Lester Ong Boon Lin, who was sued in late 2010 by Marina Bay Sands over a $240,868 unpaid gambling debt, has alleged that he was approached by an MBS marketing host who then enticed him to apply for credit when he was on a losing streak at a gaming table on May 1-2, 2010. That footage, he said, could have proven that the casino violated Section 6 of the Credit Regulations, which prohibits the extension of credit without prior request. But when he sought MBS video footage in October 2011 - more than a year later - he was told that the relevant recordings had been overwritten. During cross-examination of MBS executive director of casino finance Oncu Cifteler, Mr Ong's lawyer, Sunil Singh Panoo, of Dhillon & Partners, asked if MBS had investigated the said marketing host. "It's something we don't do as a policy," Mr Cifteler replied. MBS lawyer S Suresh of Harry Elias Partnership told the court that Mr Ong had been informed that the CCTV footage was no longer available as the "applicable retention period for the said recordings had elapsed" and the surveillance footage had been automatically overwritten. "MBS checked with the CRA (Casino Regulatory Authority) as to whether it could indicate what the retention period was. We were informed that . . . was a confidential matter that's not to be disclosed." Justice Lai Siu Chiu told the defence: "I would have thought if it was such an important thing, why didn't your client ask for it earlier? These things tend to get overwritten . . . Your client asked for it very late." In its opening statement, MBS said Mr Ong's claim was a red herring, noting that he was given credit on May 3, 2010, after he made a prior request in a credit application on May 1 or 2, 2010. MBS also said that Mr Ong had been unable to prove that he was enticed to apply for credit by the marketing host, as this individual had not been identified in his evidence or that of his friend, Ong Lye Huat. Another pivotal issue is whether Mr Ong was a premium player at the time the casino extended $250,000 in credit to him. It is MBS's case that Mr Ong is seeking to avoid his contractual obligations under the loan by "alleging technical contraventions" of the Casino Control Act (Cap 33A) (CCA) and the Casino Control (Credit) Regulations 2010 (CCR). MBS, also represented by Toh Wei Yi of Harry Elias, said that Mr Ong was a premium player when MBS extended credit to him because he had deposited $100,000 with the casino on May 1, 2010 before he started gambling. That same day, he requested a credit line of $1 million but only $250,000 was approved on May 2, 2010. He then provided a cheque as security when he withdrew $250,000 worth of chips on May 3, 2010, and signed a marker. But he lost the money, and when the debt came due on May 16, 2010, he defaulted. Mr Ong rebutted that he did not fulfil the requirement of having maintained $100,000 in his deposit account when credit was extended to him and before he began gambling on May 3, 2010. He also claimed that he did not open a deposit account or make a deposit, and that he merely exchanged $100,000 cash for chips. Mr Ong argued that Regulation 4 of the CCR indicates that a patron ceases to be a premium player upon the closure of his deposit account. But MBS disagreed, saying that Mr Ong's withdrawal of $100,000 in chips does not terminate his status as a premium player. It said that Mr Ong's premium player status remained in place until either the deposit account was closed during the period of one year, or if the credit balance was no longer at least $100,000 at the end of one year. MBS also contends that Mr Ong "erroneously construed the provisions to mean that there must be $100,000 in a patron's deposit account immediately preceding his commencement of play, ie a nanosecond before he plays". "The interpretation offered by Ong will prevent a player who established a deposit account of $100,000 from ever becoming a premium player." MBS also said that Mr Ong's interpretation contradicts the tax regime imposed under the CCA. As there are two tax rates - one for premium players (5 per cent of gross gaming revenue for the month) and another for other players (15 per cent) - the status of a patron must be known when he or she gambles. "This becomes totally unworkable if a player's status could change from minute to minute," MBS said. Another red herring, MBS said, is Mr Ong's claim that he had "borrowed" the $100,000 from an individual called Mike, in order to "insinuate" that Mr Ong's credit application was improper as the deposit funds supposedly weren't his. But Mr Ong said that he "had no clue nor was he informed about any premium player status" when he took the $100,000 from Mike and exchanged it for chips.
