Road bully spared jail. Fined $2000 instead

This case lagi more ridiculous:

 

 

 

IN A rare move yesterday, a district court judge spared a motorist a jail term and fined him instead for assaulting another man in a road rage incident.

 

Singaporean Bjorn Henrik Jacobsen, 31, was fined $4,500 after he was found guilty of hitting Mr Sim Seng Jin in the shoulder and stomach along Upper Serangoon Road in December 2008.

 

He could have been jailed for up to two years and/or fined up to $5,000 for voluntarily causing hurt.

 

Jacobsen, who was convicted earlier this year after a two-day trial, was fined another $1,500 for using threatening and abusive words on the 54-year-old chartered accountant.

 

In sentencing Jacobsen, District Judge Wong Choon Ning made it clear that the punishment was the exception rather than the rule.

That's why it takes both parties for an incident to blow up big, big. If just one party heck care, or brush it off and just drive away - nothing will happen.

 

True.

 

But then consistency in punishment is very important here.

 

It is the deterent effect the justice system wants to send out.

 

Society cannot control errant behaviour but I fully agree with the previous CJ Yong.

 

He had gone thru a long process over this issue and the moment he place his own mandatory jail sentence for road rage cases( though the written law books did not reflect this) almost all of such cases did not surface thereaafter or parties have reached a private settlement between themselves.

 

But seem like all this had been undone.

ya, my bad. They can use fastest lane. (for some reason, i thot they can't)

But some hog the lane or drift in between lane 1 & 2, so driving behind them is pretty stressful.

Having said tat, i think both tat driver & frenchman r at fault lah.

 

 

Ok seems like you got some cirtical faculty unlike some others in this forum...Yes driving is stressful and they do add to it..but do live and let live.....What Chong did was really pushing it....I really think he should have been charged for attempted murder. We must be made to realize there are consequences ...

Murder requires intention to cause death or at the very least bodily injury that in ordinary course of nature would lead to death.

 

Chong wasn't exactly intending to kill the Frenchman or to injure him severely. Probably just in a rush and bochap about others safety.

 

Dangerous driving is probably the right charge.

 

And don't be surprised if he gets charged few months down the road especially if the judgment indicates that he had a high level of culpability.

WOW... defective legal system we ve here.. in layman terms (i layman, man in the street, ordinary peasant)..

 

reckless driver.. unpunished (since he din kill anybody).... culprit become victim

 

hot under the collar biker.. punished because he isn't killed but retaliated.. victim become culprit..

Yes you are right. I stand corrected...murder does require intent/premieditation. I just cudn't help it, from the part where I read that Chong tried to sqeeze in between a car on the left lane and the bike on a 2 lane road...I kinnda jumped to this conclusion...it's in plain sight..the nike wasn;t in any way in the blind spot? So Chong knowingly endagered the biker? But I am not a lawyer or legally trained ...so it's just my 2 cents la...I would have probably broken something or beaten Chong half to death ....

Who in the right mind would want to pick a fight along the road for some minor incident? Provoked, sudden anger and revengeful nature, takes over.

 

I must teach this guy a lesson!

How can he drive like that!

Someone can possibly die on the road because of the reckless driving behavior.

The driver sitting inside the cage and yet TP is not doing anything.

Agree.....road encounters will always be there. It is within our choices whether to walk away or participate in the fight
