Two summons which should not have occurred

I'm having a terrible week in terms of vehicle related fines and I hope to seek some advice.

 

The 1st apparently occurred in march, and I only received the fine notice from lta this week. Its stated that "no cash card in IU while driving past bencoolen gantry". The thing is, I have never removed my cashcard, not even when I'm not in the car, against the advices from friends or relatives for fear or theft. I believe its the IU that's faulty as lately, even multi storey carparks have issues reading my cash card. Its not the cash card problem as I have tested another cash card, and I can only get it to read after inserting, removing, and then inserting again after a few times. I have drafted a letter of appeal, stating that the IU is faulty, and hoping for a waiver, and an inspection of the IU. Will this work?

 

The 2nd one just happened 3 hours ago. I parked at my friend's hdb block, the type where there are parking lots just next to the flats. Furthermore, its a white lot. I know I would stay for a while, so I carefully tore the coupon, 2345, at 5/5/2010, and the next one, 0015, at 6/5/2010. The simply "observant" warden gave me a ticket, saying the offence occurred at 0018. Apparently, just 3 minutes after the next coupon is supposed to start, not expire. I have two people to back me up, my girlfriend and my friend who stays there, in case they say that I tore the coupon only after receiving the fine, which is not the case.

 

Do you think I will have success against these 2 cases? The first being the IU being terrible and faulty, and the 2nd, pure negligence by the warden as my ticket clearly stated 0015 starting time, and the summon itself saying the offence occurred at 0018?

What is the offence they state on your 2nd ticket?

You could have infringed the season parking rule as majority of the carparks are for season parking tocket holders after 2230 hrs. Is your fine $50?

for the first fine, i also happen to me, i called up LTA hotline and told them that i have my cashcard inside the IU while passing thru a gantry, my IU states "ERR". LTA issued me a letter to go fo IU inspection at Viacom, and they perform the test. i went home with a slip of paper stating that my IU have nothing wrong with it.

 

2 weeks later, i got a letter from LTA stating that this matter is closed, i don't even have to pay the fine plus ERP.

TS, you know your IU has problem (you mentioned about MSCP not reading properly), why dun you get it fixed early than risk going through ERP gantry?

You are just asking for trouble and wasting your precious time.

Ic. I called them and they told me to write an email of explanation. Yeah well, I guess I'll see how it goes from there.

Did the sign outside the carpark state season parking whole day?

Yes bro. You have to check out the sign on display at the entrance to the carpark. Not all carparks have night parking.

 

For many carparks (eg. the one at my place) all the lots are only meant for season parking ticket holders after 10.30pm.

 

You are not alone bro. Numerous people have kana the same thing as you already. Even I myself kana once (never check the signboard). After that, then I realise got such thing as season parking after 10.30pm.

I think once after 12 cannot use 50cents coupon. Got to use Night coupon if that particular car park allows night parking. Also quite confuse maybe u call them n clarify....

you cant park in a season parking place after 10.30pm even for white lots. wats the carpark number

Offence 1: if your IU Is faulty, get it fix, otherwise you will have letters forever coming your way when you go pass ERP. and for each waiver, they make u go and check IU then waive..

 

Offence 2: most HDB parking,even white, will turn red after 1030pm.. check the sign board outside..

No need to be upset, just send e-mail and they will most usually waive it for you unless you keep doing it.

previously my parking lot also have this sign no night parking.... and d lots are all white....

 

got 1 time i rent a car and did not notice the sign... put overnight coupon yet still get fined....

 

appeal and waived off as 1st time offence...

 

just write in and explain the real situation....

Case 1

 

Just write to LTA. They will ask you to send your car for inspection. If IU really koyak...$150 for replacement. If not...they will usually waive the fine. Remember to use the same cashcard that you had problem with. Sometime its the cash card that gives problem.

 

Case 2

 

Photocopy or scan the 2 coupons and email/mail them to the HDB carpark section. If they say you tore the coupon after you kenna summon...ask them to prove to you. The onus is on them to prove that you cheat.
