no matter what, you still got to report to your insurance so that you are protected when the other party make a claim against you

I'm quite afraid your video evidence may not be very helpful, and at best may get you 50/50 liabilities. The problem is when turning, it's very hard to judge whether it was he cutting into your lane, or you did not turn enough, thus resulting in you hitting his backside. If it's on a straight road, and that fella cut into your lane, the video evidence would had been clearer.

Sorry to put a damper into your case. I have taken many videos with my in car camera, and have come to realise that video capture does have it's limitations.

what you can do is do a reference video on the route you frequently take.

That is a baseline of how video was recorded when turning within lane etc etc.

compare that to the accident video taken.

It may not be much but maybe a good lawyer can argue that it's up to the other party to disproved otherwise.

Just came back from the workshop reporting the accident. I was on the extreme right lane leading up to the right turn. Not turning yet. He misjudge the gap in front of me and tried to squeeze in, tinking his Mit Colt is extremely small.

I was explaining to the lady at the workshop and she dont understand wat I am saying. Once we play the video over pc, she also said clear cut case and asked if I need a courtesy car, auto or manual. :D I said wait for Insurance reply then they can start the repair. My car is 1.5yrs, so if they change bumper they will be claiming the guy big big. :D

Be advised that what the lady at the workshop says holds little water in the eventual insurance claims process, as it would be the loss adjusters and the insurance companies themselves doling out culpability, often in percentages.

At the end of the day you could be found x% or xx% responsible for the incident and it takes a corresponding effect on your insurance premiums.

The workshop's services offered to you will be paid, hook or crook, by someone, be it you or the nasty Colt driver (or respective insurance companies). Of course they'll push the full suite of services to you, including the offered courtesy car.

hmm... try to get your insurer to report to police if he claim otherwise. it's a criminal offense to make false report.

In claims like this, my take is be very very careful. If insurance companies so steady and deligently view the video then you have very little to worry about. But I have a very low opinion of insurance companies. It you can claim 100% that's a bonus.

That said, always drive defensively. Especially in turnings, give space for idiots. Don't assume just because there's video and you will have a water tight case. It just doesn't work out that way.

Is the video taken even admissible as evidence? What if the other side claims that the video is faked?

If the video footage showed the accident took place even before the turn and the other car cut in while the TS is still going straight, then it's a clear cut case. If it's during the turn, then it's 50/50.
