Adrianli Hypersonic July 17, 2009 Share July 17, 2009 Yesterday evening, I was on the right most lane queueing to turn right. Then tis Mit Colt driven by a late 40s guy cut into my lane adruptly, w/o signal lights also. His rear quarter made contact wif my front left bumper. I was seating in my car waiting for him to alight from his vehicle to exchange details and examine damage. But he did not, instead he acted blur and stayed in his car. When green light, the front cars start moving, I moved forward and cut into his lane diagonally to prevent him from escaping. Only then he alight and told me to move to the side of the road to discuss further. We turned right and stopped at the side of the road to exchange particulars and examine the damage. After exchanging particulars, he accused me of knocking into him!!! Wat rubbish!!! And said I should pay him for his car damage. I told him that it was he who cut into my lane and knocked into me not the other way round. I also pointed to him I had a car camera onboard and think carefully b4 throwing accusations. He told me to show him the video, I told him I am not obligated to show it to him but to my insurance company only. I gave him one last chance, either private settlement or insurance settlement. He still insist I knocked into him. We cannot come to an agreement and we left. I called my insurance(MSIG) and they advised me to make a report today and submit all my pictures and video evidence. The other guy is Income insured. My fren and wife viewed the footage and confirmed clear cut case, he knocked into me and I did not change lane at all. I have the footage in hand but will not post up the web, in case he find it. What kind of ridiculous claim will I expect from this idiot??? If I can polish off the scratches, I may not want to file a claim but I am afraid of him claiming against me. I'm on 50% NCD. ↡ Advertisement
Silver_blade Turbocharged July 17, 2009 Share July 17, 2009 There are of such characters around. Hope you can claim successfully against that man....tho it would be difficult to establish who is telling the truth from the point of the insurer surveyor. Drive_carcar Clutched July 18, 2009 Share July 18, 2009 I'm quite afraid your video evidence may not be very helpful, and at best may get you 50/50 liabilities. The problem is when turning, it's very hard to judge whether it was he cutting into your lane, or you did not turn enough, thus resulting in you hitting his backside. If it's on a straight road, and that fella cut into your lane, the video evidence would had been clearer. Sorry to put a damper into your case. I have taken many videos with my in car camera, and have come to realise that video capture does have it's limitations.
Nicholassoong Neutral Newbie July 18, 2009 Share July 18, 2009 Your experience sounded exactly similar to mine. I was so pissed with the other driver. Cut lane abruptly w/o signaling. So much for road courteousy! What happened to me subsequently is I did not have to take liability for the accident. I guess the insurance company concluded that it is the fault of that guy. But I claimed the damages to my vehicle through my insurance. This did not cause me to lose my NCD. But disgustingly, it affects my credibility as a driver as I had difficulties getting other insurance companies to insure me. Those who are willing to insure me quote me a ridiculously high price. WTF?? I thought it wasn't my fault? Anyway, tough luck. Just got to be more careful from now onwards. Any bros have suggestion on how I can get back some money or improve the situation? Thanks. Mzrmazda3 6th Gear July 18, 2009 Share July 18, 2009 Bro, since you have the video clip, i believe the changes of him claiming against you should be lower else because photos shows that it is his rear quarter which is slightly brushed against your front left bumper hence he could argue that it was you whom had brushed against his ... There are tons of this type of CB nan around ....
Speedsun Clutched July 18, 2009 Share July 18, 2009 If he is a bad guy, then just go back to AD to get every slight damage parts replaced.

Drive_carcar Clutched July 18, 2009 Share July 18, 2009 dun think he was turning right yet, but queueing to turn rite. Dude, I think we'll have to see the video then can comment. My own experience after taking hours of driving with my own in-car video cam, is that video can be rather deceptive, and vague. Sometimes what is supposed to be somebody swerving into your lane, looks more like you swerving into people's side. Optical illusions do play a part. That is why sometimes the insurance companies don't really bother about video evidences.
Osiris 1st Gear July 18, 2009 Share July 18, 2009 Personally, I would not told him I had video evidence. Instead let him wrote fake accident report. Not a lawyer but once report submitted and you have evidence saying he's lying, his credibility is zero. Plus I think he's chargeable because of giving false testimony. ↡ Advertisement
