Able to claim?

if someone illegal park, and i accidently brush against his car, and there is a slight scretch, he refuse my cash offer, can he go claim against my insurance?

hopeless la. he can just claim that he was stopping there to drop off/pickup passengers. and then you bump into him, cause you did not observe road safety or defensive driving. or whatever reason.

 

 

did you take photos and do you have any more descriptions, like say which road, direction, 1-lane or 2-lane etc etc.

Were there any photo taken? exchange of details? if not, dont think the person is going to take action.

accident, or was it even classified as an accident, took place at a carpark in a private office building. there are very limited slots and people always illegal park, meaning, parking in unmarked area. So while moving my car out of marked lot, i accidently brush his car. Security was informed, the other party came down, he said i should inform him to shift his car. He refused my cash offer, says want to go wkshp. Attitude not very good, illegal park still want to yaya...I already offered cash, but he dun want. I thought of asking him claim my insurance. My thoughts are, spray only, at most 200, excess already 500 min, hard to affect my ncd or watsoever....any suggestion?

okie. since it's a private car park.... a few advices.

 

1) if you want to spar with him, ignore him, go find the building security guard or cctv as evidence of him illegal parking.

 

2) if no cctv, completely ignore him, and act blur when your insurance come calling.

 

3) report to your insurance that such a thing happen etc etc, and wait for his claims against your insurance.

 

4) and honestly, if he refuse your cash offer, do you for 1 moment think he just going for respray?

He can just say bumper needs to change, blah blah, repair cost hit $700 to $1000.

He illegal park, he was in the wrong, why should you offer cash to a inconsiderate driver? He deserved it, you should ask him to compensate instead.

have to agree. hit stationary car = most likely is suck thumb. Worst case is go court dispute = they ask you how come you didn't just stop and wait?

 

but do you have proof is illegal parking??? need photos, videos, witness. do you have them?

i guess it's just better to inform your insurance, with all the necessary proofs, and then just wait.

aiyah... say somebody cut your queue, or is just plain irritating or blocking your way, can you just bash him the person up? if you do just that, don't be surprise if the court deem you guilty of assault.

 

and moreover the person illegal park in a private car park. see if the building management willing to help you out anot.

Ok .... that person illegal parked ... so at most he ask the authority to fine him $70?

 

So far only drunk driving is excluded from insurance cover.

bro, quite tough...happened to me before...the uncle jus said to me "i illegal park means u can bang me?"

in the end, i jus close the issue la...luckily he willing to go to my wkshop and i jus paid the bill...

 

i suggest u try talking to the guy again....now insurance premium so jialat not worth losing ur no claim status...
