Got hit behind by a motorbike. complicated case. need help

Dear bros

 

Today I was driving along CTE on the the second lane and then I filtered to the right lane. after filtering in about 5 seconds, the car in front of me jammed brake. so i jammed brake. I did not hit the car in front of me. but the bike did not manage to stop in time and hit me. I was already in the lane when he hit me. he hit me in the middle of the bumper. Now it is a TP case as injuries was involved.

 

Qn:

 

Will i be able to claim against him for the damages or can this case be disputed as he is a motorbike?

Apply common sense, and its nearly 100% his fault.

 

Same thing happened to me. He was lightly injured, but went to hospital.

 

I had to make a police report. Claimed everything from the biker. No rise in premiums for me.

Poor biker. So little reaction time for him when you chose to squeeze into his safety zone and jammed brake. You have to admit that you caused the accident too. [shakehead]

I have a same case years back, same place same senario, i won the claim against the motorbike.

I did not squeeze into the bikes safety zone. I was already in the lane for around 30-40 secs when the car in front of me jammed brake cos he wanted to filter to 2nd lane and just nice a car from the 2nd lane came out. I also had no choice but to jam my brake. or not i will hit the car.

 

So do u think it is still my fault?

Yea. I also had to wait for TP to come then they take the drawing and everything. tml 11am still have to go down to ubi tp hq to take statement.

 

yar i just want this to be over and move on. i wasted too much time on this thingy.

First, you say 5 sec, then you say 40 sec. Big difference. So which is which? 40 sec, then fair enough, biker did not keep his safety distance. Anything 5 sec or less, you jammed brake, you are asking for it.

just report to you insurer according to what happened. if the vehicle back is damaged, then its a clear cut case. but if there are side damages. to the car, it will not be as clear cut.

I reported to my insurer already. but my workshop say that if the IO charge me, then i will lose the case. haizz

 

unlucky. kena bang from behind also can lose case.

If 40secs then the biker hit you, i think the case is not complicated at all.... 40secs is a long time when driving.

Very confused. You meant the jammed brake occurred 35-45sec later after you switched the lane?

Y not u juz say 45 seconds later? Y muz add in the 5 seconds after 40 seconds? I hope u din give your statement like that, else, it will raise a reasonable amount of doubt in your statement and thus, kena discredited.

 

Anyway, if the bike hits u at the middle of the bumper, then it is a good chance that u win ur case against the biker.

 

If you had given your statement the way u did in MCF.... hard to say liao.

Claim the crap out of the Motobiker.... even if his legs are broken .. CLAIM HIM

the accident happened on the extreme right lane?

 

if yes, then its the bike's fault. Bikes are not supposed to be on extreme right lane......
