Pedra Branca: MY trying to play dirty again..........

MY it seems has instructed the media there not to refer to Pedra Branca as Pulau Batu Puteh but only as Batu Puteh, dropping "Pulau" which means "Island" in Malay. The reason is that an island has territorial waters whilst an outcrop or rock does not. An island is an island even if they do not choose to call it that. Those morons think that their dirty trick is going to influence any forthcoming talks concerning the sea boundaries of SGP and MY.

The matter of the territorial waters (12nautical miles) and EEZ (200KM) around PB, has not been worked out between SGP and MY. Oil, fishing and other natural resources in the sea around PB are of importance to both countries. The two sides have yet to meet on this. That is not settled although ICJ has awarded PB to SGP.

Not sure what the law of the sea states but I thought if the middle rocks and south ledge are not visible at high tide then they are not considered islands. Means cannot claim territorial waters or EEZ right? Wonder if that's the angle they are trying to protray for Pedra Branca as well. Claim that if no lighthouse or structure it would be underwater?

Only Pedra Branca is considered an island. The Middle Rocks are outcrops and not islands. As for the South Ledge which is visible only at low tide, ICJ decided that it belongs to whichever country whose territory it is in.

 

Only an island has a territorial boundary and EEZ. As such, middle rocks being outcrops, do not have any. Therein lies the reason for MY trying to downgrade PB from an island to an outcrop.

If middle rocks have no territorial boundary, then it follows that the sea around them is within the boundary of PB. MY fishermen should therefore not be allowed near PB unless SGP make a special concession for them in the interest of good neighbourliness.

heard from news that the MY politicians are trying to reverse the ICJ verdict. They seems to be very unhappy over the decision and wants to find new evidence to appeal their case. Seems that they can do that within the next ten yrs according to the law. But they are not gentlemen as both sides gov has already made a pact not to appeal or pursue further no matter what the verdict by ICJ is! Sore loser - MY !
