(Quite urgently) need opinions and advice..

my friend has been found suspicious of taking 5 pens (corporate gifts) when the company realised there were 5 pens short before delivery to customer was made.

 

It was just 5 pens with laser pointer and the company started a big hooha to investigate.. They went through all the videos from camera for the few days.. called in all the ones caught on video.. First round of questioning over.. then came another second round.. They called the second round "Disciplinary Inquiry". When asked what does that mean, as there were no disciplinary violations on the side of my friend. They said they 'highly suspect' he and 2 others took the pens.

 

During second round they got in another manager supposedly to be neutral party, but instead he keep wanting to nail my friend as the highly suspected one as he was backfacing the camera too long at the area of where the pens were. When asked why not let police be involved, they said they will report to police. At least police will just say 'helping with the investigation' rather than 'you are highly suspected of taking'

 

I have a few questions I hope bros/sis here can help..

 

1. Up till now, is my friend considered being accused of taking the pens?

2. Can the company issue a letter and ask him to leave because they suspect him of taking?

3. Can he report to the police about the missing pens and let police investigate?

4. Can he demand for an apology after the investgation proved his innocence?

5. Can he take legal actions against the company, for suspecting/accusing?

1. There could be hidden agenda behind [sly]? Afterall, it is only 5 pens. Are these expensive pens by the way?

 

2. Actaully, they can't do much to him unless there is hard evidence. If they officially accused him and is unable to produce proof, he may suit them under defammatory case. if your friend wants to spill the beans, best is your friend record down the conversatiobn secretly when ask to drink coffee again. Better still, if they put it down in writing or make it public. With these, go to ministry of labour for advice...before engaging a lawyer.

Yes

No, he is not the owner of those pens.

If he can find evidence, yes.

 

5. Can he take legal actions against the company, for suspecting/accusing?

If he can find evidence, and can afford legal fees, yes.

even he is found to be innocence, i guess there is no point in staying.

I doubt the police will even want to bother themselves with 5 missing pens

There definitely is hidden agenda. Those pens with laser pointers very cheap only, it's not as if those were luxury pens like genuine Mont Blancs. [nod]

Since no one was caught red-handed and no strong edvidence/witness. It's as good as no case. Your coy is just wasting time doing these "investigations".

 

They can't do anything to your friend And I dun think your friend wants to take action on his coy just bcos they suspect him of stealing a few pens. [rolleyes]

 

Ppl should learn how to move on and learn to be more cautious the next time.

1. From what I know the pen cost less than $10. Hidden agenda? meaning they wanna find a scapegoat? or wanna frame someone?

 

2. So far they keep using highly suspicious.. but that should be considered accused already right?

Seems v much like it.. How can a total of less tha $50 lost of pens create such a big hooha.. Now problem is dunno if they did count properly when they received from suppliers before they shipped..

Yeah! and the whole thing was left to be conducted by a i-heard-inexperienced-young-human-resource-manager.. and heard the way she put it was like questioning criminals.. [laugh] wat a clown!

if your friend need a job then sallow the sxxt if there is not proof. else make it a big whoo haaa kill all those he dislike.

 

cos it will be very difficult to work in that company. there is not way there will be trust from the management to him. any small leak or what they will point to him and accuses him.

 

this is a obvious setup to kill him off. best is to make a big whoohaa let the media and MOM know abt this.

 

they will need to compensate him if they wan him to leave else a 24hr notice.
