Apollo 1st Gear August 9, 2007 Share August 9, 2007 nope.. SLA is contesting that since 2005, they stopped paying license and therefore SLA has every right to sue for infringement based on copyright of their intellectual property. before that, SLA has issued an exclusive license to STdirect so tat gives STDirect the rights to use as well as the right to protect themselves fr any infringement. therefore annie wan who uses the data published by STDirect r subjected to kopi right infringement.. simple fact tat cannot be contested. the diff now is STDirect did use SLA's document in order to further advance them with more data, they did not escape the fundamentals that the backbone of documents were fr SLA. but if one copies fr their site again, that does not exclude STDirect fr taking legal action although u r right in part that they do not hv full exclusitivity to the whole document, any compensation post 2005 should b on a reduced scale. ↡ Advertisement
Higgsboson Clutched August 9, 2007 Share August 9, 2007 but it cant be disputed that SD did use SLA stuff right from the begining to do biz and they do not have full 100% rights to the licensed product, so wouldnt it be possible for a class action suit against SD? anyway, i dont think the small company got $ to take another blow. Apollo 1st Gear August 9, 2007 Share August 9, 2007 eh.. i think u still dun understand. before 2004, SLA did issue the map and a license to use them to SD. SD paid for the annual license. the license is exclusive to them. so any benefit or loss arising fr the use / misuse of the license SD can profit fr it. post 2004, SD decide not to pay for the license and did smthg to the map. here there is no denying there is a portion in the map which include their work. if u infringe using their map post 2004...u can dispute the claim becos SLA map is free but u cannot dispute in total this is not SLA map. so mebbe if they claim u $100, chances r u may only pay $30. but if they take $100, this does not prevent SLA fr claiming fr them $
