Who is liable for this?

Was on the road early this morning and wondering about this: If a car breaks late for some reason, and the car behind also breaks late, thereby causing the third car to kiss the second car. Who is at fault? Is it the third car for not keeping a safe distance and speed?

 

Hope I did not confuse anyone. :)

The last car is at fault. Based on what has been taught during driving lessons, one should keep a distance of 10m per 10km/h driving speed. So if you are too close and you kiss the one in front, you sure at fault.......

as long as the last car kiss the car in front - bumper to bumper.. the last car lose hands down.. regardless of how the car in front brake fast or slow. It's the responsibility of the car behind to keep a proper lookout & distance for the car in front. one can argue that the car in front suddenly brake for no reason, but still when come to insurance, last car sure lose.. [shakehead]

if let's say the 2nd car hits the 1st car first, even before 3rd car hits 2nd car ,then 2nd car can say that becos the 3rd car hits the 2nd car and caused the 2nd car to move forward to hit 1st car. so in a chain collision involving a few cars, it does not matter who hits who first, the last car will take all the blame & all insurance will claim from the last car.. [nod]

let me answer your question..coz i kena before..i was the last car..

 

1st car stop, 2nd car stop in time..i din stop in time, i hit the 2nd car, in turn the 2nd car hit the 1st car..

 

i compensate both of them..cost me near to 400 bucks..

that is 2nd car telling a lie. if the 2nd car admit that he hit 1st car first, then how? should be 2nd pay 1st, 3rd pay 2nd, right?

I was in exactly such a situation.

 

Due to some commotion upfront, the car in front of me stopped in time, and I jammed my brakes and also stopped in time, however the merc behind react abit too slowly, slamming me against the car infront.

 

When I got out of the car, the guy infront acknowledged that I stopped in time (he saw thru his rearview mirror)... the lady behind did not acknowledge blame for both cars, only mine.

 

When I towed the car to the mechanic, the owner suggested that I call up the first car owner to collaborate my story or it will be difficult to claim against the 3rd car;s insurance.

 

So the important thing here, is that you need the very first car to acknowledge that you had stopped in time in the first place...

think should be 1 car length per 10 km/h...

if 10m, then at 100 km/h, each car is 100 m apart liao...
