Now kena Civil suit for accident

As some of u might know, a friend of mine was involved in an accident abt 9 mths ago where he hit a car wash bloke while creeping forward whilst in a car wash.

 

The accident occured at about 5 km/h type of speed as vehicles moving within a car wash are all moving at a low speed.

 

Briefly, it was a case of the car washer signalling him to move forward and then jumping in front of his vehicle carelessly.

 

At that point in time, he followed all procedures and called for the police and ambulance etc.

 

The police have since acquited him of any charges. Although slapped with an initial fine of $200 and 9 points for careless driving, an appeal and further investigations resulted only in a written warning to drive carefully.

 

The injured fella was not badly hurt. Accodring to the investigation officer, it was only some bruises.

 

Now, 9 months later, he recieved a summons from the sub court to attend a civil claim from the injured fella.

 

What usually is the procedure?

A court appearance is a must, if not a warrant of arrest will come. Consult your car insurance, which the event must and should have been reported, they will advice and probably assign you to their legal aid. Take it from there as they will definately be the 3rd party sued, if the claim cannot be made to you.

was insurance reported after the accident? if yes, den call ur insurance company, it should be becuz they have been slow to settle the claim.

but let's see that bugger make a succesful claim.

 

next time, wanna claim some money, signal a car to proceed at the zebra crossing and then jump in front of it :)

they gonna sue the insurance company for not paying. as your fren is involved, they only c.c him a copy. happened to me b4.

think that bugger's work permit finishing soon... so try to claim something to go home built a big house. Wat a joke, signal people go forward, then cause accident to himself... reminds me of same accident in Jakarta.... these people jump in front of cars so to cause accident and claim from the driver. dont want to live.

i think dat fellow is trying to claim >5k amount for personal injuries. cause less den 5k subordinate court don bother wan. when claiming personal injuries very hard to assess the damage wan as dat fellow can keep going back to doc and complain here pain there pain so keep your finger cross

 

edit: by the way, when talk about civil suit, theres two thing, first liability den quantum. as long as die die don admit 100% liability den have to go court fight it out.

if one of the dickhead cleaning the rims using his fingers and one of the cleaner ask u to move forward and u break his fingers. Who's fault? I can't see the dame tyre inside the car with foam all over. So ppl...better watch out for this incident.
