Hit by reversing car, who is at fault?

Hi, posting on behalf of my colleague.

 

His car got hit by a reversing car in car park but the other driver is now blaming my colleague and unwilling to settle the repair cost.

 

Please see diagram.

Red car (my colleague) stopped behind the blue car.

Red car waited for blue car to clear, but then blue car engaged reverse gear.

Red car tried to horn, but horn not working.

Red car hoped that blue car would not reverse so much.

But blue car continued to reverse and hit red car which is stationary.

 

My colleague is now worried that he may lose his NCD by claiming insurance. This is because he thinks fault is with him for having a spoilt horn and did not react in time to reverse out of the way.

 

Please advice. Thanks.

In this case, reversing car at fault.. but problem is that if there r no witnesses, the other car can claim your friend hit him instead.. [sweatdrop]

So what is the damage ? Is his rear light damage ? You can ask the workshop to investigate why this reverse light is engaged while accident occurred. That can prove he reverse and bang onto your car.

Which Carpark is your Friend At. Look out for CCTV. Ask your friend to insist on his stand. These ppl are like that they see ppl they bully. I was also involved in such case before That guy just came out and shouted at me. So i also tu lan started quarreling then want to call for TP, that guy shrink....

 

Your friend need to seek witness or CCTV. If all these is not within the area then he better insist on his stand....

50 ~ 50 case. yr friend claim him, he also claim yr friend. with witness will support your case. Most likely NCD lost a little one. [shakehead]

 

The blue car is nuts.... think he purposely try to find trouble.. or maybe he got something wrong with his sensor or bumper liao.. purposely find trouble so can repair and claim insurance... [mad]

What is the extent of damage for both parties? If the Blue car's reverse light blub is damaged, the fuse inside will show exposure to air when it was lighted. Thus can prove easily that the other part reversed into him.

 

But this is quite troublesome and would probably require lawyer to be involved cause insurance companies like clear cut cases. So you get your friend to ponder over it.

 

On hindsight, it would have been good if your friend or anyone for that matter record the conversations immediately when you speak to the other party. Most phones have recording features or video features.

In Singapore, as long someone car back side kena hit...it will alway the behind car fault (by default) unless you got video or witness to proof that the car reverse and hit you...otherwise LL to claim own insurance... [shakehead]

 

what a good law here is Singapore...that's why alway good to kena hit behind by someone... [sly] ..so that can claim the other party... [lipsrsealed]

Remember the case where this TP drove his bike into the dumb truck backside at the junction and go heaven? the truck driver was sued for "ebrake" and subsequently jailed. Many quarters start grumbling why truck driver in the wrong when rule says exactly backside kisser always wrong... but to no avail. [shakehead] TP kept quiet about whether that kisser was reckless but kept blaming the driver. [shocked]

 

So, it depends on who you are, sori to say. [:/]

got onboard video camera or not? mine have one, once i idiot just lightly kiss by reversing. slight dink and license plate damage. farker deny also. i then proceed show him the video that comes with timestamp. he LPPL paid me $200 after that.

I was playing with this thought of installing the video system too. What system did you install? How much was it? Which workshop do you recommend?

I kenna tis kind of accident before, almost the same as your friend just tat my horn is working sweatdrop.gif .......however, no witness and the car in-front claim I hit him furious.gif .....in the end, insurance settle for 50-50 bigcry.gif
