Becuase the tree did not grow there by itself. It was planted there artificially by humans. National Parks Board to be exact. Therefore they are legally responsible for it's actions. Simlairly, suppose a concrete slab from a building fell and hit a car during a storm. Same reasoning. What's more it fell probably becuase of infestation.
