Mica_blue Neutral Newbie March 1, 2006 Share March 1, 2006 (edited) Hi guys Need some advice here. I got a letter from TP stating the other party is at fault , points deducted + fine . Based on this letter ,Shold I engage my own lawyer to claim for compensation eg (injury suffered , loss of use etc?) from the other party? The reason for this is , my insurance policy does not cover loss of use and medical claims amounts up to $300 only . Also the other party at fault is under the same insurance co. I am afriad they ask me to negoitate and shortchange me . Also , legal fees for engaging a lawyer . Is it based on commission or the other party at fault, pays for it? Acemundo Supercharged March 1, 2006 Share March 1, 2006 whether u get the letter from tp or not, ur right to engage a lawyer is not affected. from what i understand, u want to claim more than the standard allowed under insurance practices or allowed by ur insurer, that's why u contemplate engaging a lawyer. shldn't be disallowed alto not sure how ur insurance company will view you when comes to renewal time. Don't think lawyers can charge based on commission. But some lawyers are open to writing off their time cost if they fail to recover a single cent for their client. Tj75 Neutral Newbie March 1, 2006 Share March 1, 2006 I believe, if your claim is not complicated it would be preferable to deal with the insurer directly as this could result in faster settlement. It would be to the insurer's advantage to settle this way as it would avoid the legal cost. Talk to the insurer first and find out if they are receptive....
